This End User License Agreement is a binding legal agreement between you and vividthemes.net. Purchase, installation or use of any service or content provided on vividthemes.net signifies that you have read, understood, and agreed to be bound by the terms outlined below.

NOTE: The term Templates may be used interchangeably to refer to Templates, Themes, or Styles or what ever term constitutes a "skin" for a particular platform

Theme Licensing & Use:

All vividthemes.net themes are GPL compliant.All PHP portions of the templates, themes and styles are licensed under the appropriate GPL license of the parent platform.All images, cascading style sheets, images source code (.PSD) and included JavaScript are NOT GPL and are released under the vividthemes.net Proprietary Use License unless specifically authorized by vividthemes.net. Elements of the themes released under this proprietary license may not be redistributed or repackaged for use other than those allowed by the Terms of Service.You may not place any non-GPL portions of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from vividthemes.net

Theme Updates

All themes are consistently tested and updated to be compatible with the latest stable version of WordPress. However, We can give no guarantee that current versions of vividthemes.net themes will be compatible with previous versions of WordPress, or that previous versions of themes will be compatible with the current version of WordPress.

Theme Delivery

As soon as your payment has fully cleared, you will receive an email containing download link, or .zip file with theme. If you do not receive within within 24h of your purchase please feel free to contact us by clicking "Contact us" at the top of website.

Theme Warranty

vividthemes.net WordPress themes are provided "as is" without warranty of any kind, either expressed or implied. In no event shall vividthemes.net be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use of said products. Some states or jurisdictions do not allow the exclusion of certain warranties. Nothing in this section should be construed as excluding or limiting any warranty beyond what is permissible under applicable law.

Theme Support

vividthemes.net WordPress themes are provided "as is" with no implied meaning that they will function exactly as you wish or with all 3rd party plugins, components and modules. You acknowledge by your use of the themes that it is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with the themes.Further, We offer support for installation, customization, administration, etc for an additional fee.

Theme Modifications

You are authorized to make any necessary modification(s) to our products to fit your purposes. You may not however redistribute or release non-GPL portions of the templates as GPL or otherwise. You must also not change or remove the copyright information in cascading style sheets. You may however remove our copyright from the footer of the templates if needed. No use of our trademarks is granted under this Agreement. Porting non-GPL portions of our templates to other platforms and content management systems and redistributing as GPL or otherwise is also strictly prohibited.

Browser Compatibility

All themes are tested and optimized for the most common web browsers. Either way, browser compatibility should be tested against the demonstration themes on vividthemes.net. Please ensure that the browsers you use will work with the themes as we can not guarantee that vividthemes.net themes will work with all browser combinations.

Use Of Content

You acknowledge that the site contains or may contain material (collectively the "Content") which is protected by copyright, trademark or other proprietary rights; therefore, you are only permitted to use the material as expressly authorized by vividthemes.net. You may not transfer or sell, reproduce, distribute, or in any way exploit any of the content, in whole or in part, except with an expressly permitted agreement from vividthemes.net

vividthemes.net Proprietary Use License

The vividthemes.net Proprietary Use License is a GPL compatible license that pertains only to the images, cascading style sheets, images source code (.PSD) and JavaScript elements of vividthemes.net Templates, Themes, Styles (Joomla, Drupal, WordPress, phpBB3, etc). produced by vividthemes.net. As stated by the GPL version 2.0 license, These elements of product that are not compiled together but are sent independently of GPL code, and combined in a client's browser, do not have to be GPL themselves. These images, cascading style sheets, images source code (.PSD) and JavaScript elements are copyright vividthemes.net and can be used and manipulated for your own or your clients purposes. You cannot redistribute these files as your own, or include them in a package or extension of your own without prior consent of vividthemes.net.

Vivid Themes Affiliate Program

Following section applies to those who participate in our affiliate program. In order to participate in vividthemes.net affiliate program, you (Affiliate) must agree to these terms of service.

Description of Affiliate Program

If you refer a new customer to vividthemes.net you will receive a commission of every confirmed purchase of referred customer. In order to track your commission all referred customers must come from following your referral link. If referred customer comes to vividthemes.net directly, without your affiliate link, those purchases will not pay referral commission.

Affiliate Tracking and Commissions

To participate in the Affiliate program, you must use link and banner ads with your unique affiliate id, which can be found in Affiliate account area. All sales are tracked using visitor IP and cookies. We can only guarantee that sales will be tracked if visitor who follows your affiliate link:

Have cookies enabled in their browser

Do not clear their cookies

Have not been previously referred by another affiliate

Have been referred via external site and not through vividthemes.net

Does not use same IP as referrer

Our affiliate system place cookies in user browser which will remember affiliate referrer for 90 days. During that period if user doesn’t delete cookie, affiliate will get commission for every successful purchase.

Affiliate Payments

All affiliate payments are processed at the beginning of the month. Current payment methods are Skrill(Moneybookers), PayPal and Bank transfer. For Skrill(Moneybookers) and Paypal minimum payment is 40€, and for Bank transfer minimum payment is 100€.

If Affiliate account reaches minimum payment threshold it will be paid between 1^st and 5^th of the following month. In some cases of non working days and holidays Bank transfers can take longer depending on Bank work hours.

If Affiliate account didn’t reached minimum payment threshold, all funds are transferred to next month until account reaches enough funds to get paid.

Affiliate share commissions are processed only for confirmed orders older than 14 days. In case payment is refunded for specific order, then the commission for this payment will be removed from affiliate account.

If Affiliate already received commission for specific payment which is later refunded, that specific amount of refunded order will be deducted from future commission.

Double check your payment information’s, and make sure that payment information’s are correct and that you(Affiliate) can receive payments on specific payment method you selected. We can not hold responsibility for lost transactions or wrong payment address.

Affiliate Account

If we suspect that you are engaged in fraud, your account may be terminated without notice.

Only one person may use an account, and each person may only create one account for themselves. Creating multiple accounts is not allowed.

You can not use your own affiliate link to purchase themes for your self. If we suspect that you purchased theme for yourself using your affiliate link we might put on hold commission for that purchase until we resolve issue. If we confirm that purchase is maid from your own affiliate link, you will not receive commission for that order.

Compilance With Laws

As a condition to your participation in the Program, you agree that while you are a Program participant you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority that has jurisdiction over you, whether those laws, etc. are now in effect or later come into effect during the time you are a Program participant. Without limiting the foregoing obligation, you agree that as a condition of your participation in the Program you will comply with all applicable laws (federal, state or otherwise) that govern marketing email, including without limitation, the CAN-SPAM Act of 2003 and all other anti-spam laws.

Disclaimers

We make no express or implied warranties or representations with respect to the Program or any products sold through the Program (including, without limitation, warranties of fitness, merchantability, noninfringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of the Product Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL vividthemes.net BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF vividthemes.net OR AN AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.

Changes to our Terms of Service

vividthemes.net reserves the right to change the Terms of Service from time to time. vividthemes.net shall not be liable to you or any third party should vividthemes.net exercise its right to modify, suspend, limit or discontinue any feature its products or services.
